They also apply to any other gift websites we may operate from time to time, unless different terms are clearly shown on that website.
Some of these websites may be used for specific types of gifts, seasonal gifts, or targeted gift collections. The business behind them remains Syxth Limited trading as Nicely Personalised.
4. Our products
We sell personalised, made-to-order and non-personalised gifts.
Many of our products are created, engraved, assembled, finished or packed to order. This may include names, dates, messages, family details, recipient details, photographs, artwork, or other information supplied by you.
Product details, sizes, materials, colours, prices, options and dispatch estimates are shown on the relevant product page.
We may change, remove or discontinue products at any time. This will not affect orders we have already accepted.
5. Personalised and made-to-order products
Many of our products are personalised or made specifically for you.
This means you are responsible for checking all personalisation details before placing your order, including:
We will usually make your order using the details exactly as supplied by you.
Where we believe there is an obvious issue, such as missing information or a layout problem, we may contact you before making the item. However, we are not responsible for spotting spelling mistakes, date errors, incorrect names, or other customer input errors.
6. Design previews and product layout
Some of our websites may show a live preview, product visualiser, mock-up, proof, or example image.
These are provided to help you understand how your item may look, but they are a guide only. The final engraved, printed, cut, assembled or finished product may vary slightly.
We may make small layout adjustments to improve the finished result. For example, we may adjust spacing, line breaks, text size, alignment, or positioning so that the personalisation fits properly and looks balanced.
We may also use the personalisation details you enter during your shopping session to show previews of related or matching products. These previews are for guidance only and are intended to help you decide whether to add another product to your order. You will only be charged for products that you choose to add to your basket and purchase.
We will not normally change the meaning of your wording unless we contact you first.
7. Materials and natural variations
Many of our products are made from natural or specialist materials, including wood, oak, oak veneer, stainless steel, brushed stainless steel, acrylic, glass, paper, card, fabric, or other materials.
Natural materials can vary in grain, colour, shade, texture and finish. Engraving tone, contrast and depth may also vary slightly from item to item.
These natural and manufacturing variations are part of the character of personalised and handmade gifts and are not normally considered faults.
Product photos are for guidance. Screen colours and brightness settings can also affect how images appear.
8. Decorative products and product safety
Some products are decorative keepsakes only and are not intended to be used as tools, toys or safety equipment.
For example, our freestanding saw ornaments are decorative gifts only. They are not functional saws and must not be used as tools.
Unless a product page clearly says otherwise, our products are not toys and should be kept away from young children where small parts, sharp edges, cords, packaging or other hazards may be present.
Please use all products sensibly and for their intended decorative or gift purpose.
9. Placing an order
To place an order, you will usually need to:
1. choose the product you would like to buy;
2. select any available options;
3. enter your personalisation details, where required;
4. add the product to your basket;
5. check your order carefully;
6. enter your delivery and contact details;
7. choose a delivery method, where options are available;
8. complete payment.
Before placing your order, you will have the chance to check and correct your details.
Please make sure your email address and delivery address are correct, as we will use these to contact you and send your order.
10. Order acknowledgement and acceptance
After you place an order, you should receive an order acknowledgement by email.
This confirms that we have received your order, but it does not necessarily mean that we have accepted it.
Your order is accepted when we either:
If we cannot accept your order, we will contact you and refund any payment you have already made for that order.
11. When we may refuse or cancel an order
We may refuse or cancel an order if, for example:
If we cancel an order before it has been made or dispatched, we will refund the amount you paid for the cancelled item.
12. Prices
Product prices are shown on our websites.
We may change prices at any time, but price changes will not affect orders we have already accepted.
We are not currently VAT registered and do not charge VAT on our products. This means our receipts and order confirmations will not show VAT as a separate amount.
Delivery charges, where applicable, will be shown before you complete your order.
13. Payment
You must pay for your order during checkout.
We accept the payment methods shown on the relevant website at the time you place your order.
Payments are handled securely by third-party payment providers. We do not normally see or store your full card details.
If payment is not authorised, we may not accept or process your order.
If you believe there is a payment issue, please contact us at support@nicelypersonalised.com so we can try to resolve it quickly.
14. Dispatch and delivery
Dispatch estimates are shown on the relevant product page, delivery page, checkout page, or order confirmation.
Because many items are personalised or made to order, dispatch times can vary depending on the product, the time of year, order volume, and whether we need further information from you.
Delivery estimates are not guaranteed unless we clearly say otherwise.
We are not responsible for delays caused by postal services, couriers, customs, weather, strikes, incorrect addresses, failed delivery attempts, or other events outside our reasonable control.
More information is provided in our separate Delivery Policy.
15. Incorrect delivery details
You are responsible for providing a full and accurate delivery address.
If you provide an incorrect or incomplete address, your order may be delayed, returned to us, or lost.
If an order is returned to us because of an incorrect address, failed delivery, refusal to accept delivery, or failure to collect from a delivery office, we may ask you to pay the reasonable cost of redelivery.
For personalised items, we may not be able to refund the product cost where the item has been made correctly and the delivery issue was caused by incorrect or incomplete information supplied by you.
16. Changing or cancelling an order before production
If you need to change or cancel an order, please contact us as soon as possible at:
support@nicelypersonalised.com
We will do our best to help.
However, because many products are personalised and made to order, we may not be able to change or cancel an order once production has started.
Production may start quickly, sometimes on the same working day or the next working day after your order is placed.
17. Cancellation rights for non-personalised products
If you are a UK consumer buying a non-personalised product online, you usually have the right to cancel your order within 14 days after the day you receive the product.
You then usually have a further 14 days to return the product to us.
To cancel, you must tell us clearly that you wish to cancel. You can do this by emailing:
support@nicelypersonalised.com
Returned products should be unused, in a resaleable condition, and returned with their original packaging where reasonably possible.
Unless the product is faulty, damaged, not as described, or we have made an error, you are responsible for the cost of returning the product to us.
18. Personalised and made-to-order products
Because personalised and made-to-order items are created specifically for you, they cannot usually be cancelled, returned or refunded if you change your mind.
This includes products made with names, dates, messages, family details, custom wording, photographs, artwork, or other personalisation supplied or approved by you.
This does not affect your legal rights if an item is faulty, damaged, not as described, or if we have made an error with your order.
19. Faulty, damaged or incorrect items
We take care when making and packing your order. However, if something goes wrong, please contact us as soon as possible.
If your item arrives damaged, faulty, incorrect, or not as described, please email:
support@nicelypersonalised.com
Please include:
If the issue is our fault, we will put it right. Depending on the circumstances, this may involve a replacement, repair, partial refund, full refund, or another fair solution.
We may ask you to return the item to us before we issue a refund or replacement.
Nothing in these terms limits your statutory rights.
20. Customer errors
We are not normally able to offer a free replacement or refund where an item has been made correctly using details supplied by you, but those details were wrong.
This includes mistakes with names, spellings, dates, punctuation, grammar, addresses, product choices or message wording.
However, please contact us if this happens. We are a small family business and will always try to help where we reasonably can. In some cases, we may be able to offer a discounted replacement.
21. 90 Day Love It Guarantee
We offer a 90 Day Love It Guarantee on purchases made through our eligible websites, including Nicely Personalised and Gifts For Him.
This guarantee is offered in addition to your statutory rights.
The guarantee is designed to give you extra confidence when ordering from us. It does not reduce your legal rights if an item is faulty, damaged, not as described, or made incorrectly by us.
The full details of the guarantee are set out in our separate 90 Day Love It Guarantee page and/or our Returns and Refunds Policy.
Unless we state otherwise, the guarantee applies to websites operated by Syxth Limited trading as Nicely Personalised.
22. Returns
Our returns process is explained in our separate Returns and Refunds Policy.
Before returning an item, please contact us at:
support@nicelypersonalised.com
This helps us deal with your return properly and give you the correct return instructions.
Unless the item is faulty, damaged, not as described, or we have made an error, you are responsible for return postage costs.
We recommend using a tracked delivery service when returning items.
23. Refunds
Where a refund is due, we will usually refund you using the same payment method you used for the original purchase.
Refund timing may depend on your bank, card provider, payment provider, or platform.
Where you return a product to us, we may wait until we have received the returned item, or evidence that you have sent it back, before processing the refund.
We may reduce a refund if a returned non-faulty item has been handled more than necessary, damaged, used, or returned incomplete.
24. Offers, discounts and promotions
From time to time, we may offer discount codes, sales, bundles, free delivery offers or other promotions.
Promotions may be subject to separate terms, expiry dates, product exclusions or order value requirements.
We may withdraw or change promotions at any time, but this will not affect orders we have already accepted.
Only one discount code may be used per order unless the website clearly allows otherwise.
25. Reviews, photographs and feedback
If you send us a review, photograph, comment or other feedback, we may ask for your permission to use it in our marketing.
We will not knowingly publish personal information, such as your full address, contact details, or private order information.
If we want to use customer-supplied photographs or detailed personal stories in a more prominent way, we will aim to get appropriate permission first.
26. Intellectual property
All designs, photographs, text, graphics, product layouts, website content, branding and other materials on our websites belong to us or our licensors unless stated otherwise.
You must not copy, reproduce, sell, distribute, modify or use our content for commercial purposes without our written permission.
When you provide names, messages, artwork, images or other content for personalisation, you confirm that you have the right to use that content and that it does not infringe anyone else’s rights.
We may refuse to make products containing content that we believe may infringe intellectual property rights or other legal rights.
27. Privacy
We will handle your personal data in accordance with our Privacy Policy.
This includes information needed to process your order, make your personalised item, deliver your order, handle customer service, process payments, prevent fraud, meet legal obligations, and run our business.
28. Our responsibility to you
We are responsible for losses you suffer that are a foreseeable result of us breaking these terms or failing to use reasonable care and skill.
We are not responsible for losses that are not foreseeable.
We are not responsible for business losses. Our products are sold mainly for personal, domestic and gift use. If you buy products for business, resale, commercial or promotional use, we will not be liable for loss of profit, loss of business, business interruption, loss of goodwill, or loss of business opportunity.
Nothing in these terms limits or excludes our liability for:
29. Events outside our control
We are not responsible for delays or failure to perform our obligations where this is caused by events outside our reasonable control.
This may include postal or courier delays, strikes, extreme weather, fire, flood, illness, power failure, machinery breakdown, supply issues, internet failure, payment provider issues, changes in law, or other events we could not reasonably prevent.
If such an event affects your order, we will contact you where reasonably possible and try to find a fair solution.
30. Changes to these terms
We may update these terms from time to time.
The terms that apply to your order are the terms shown on the relevant website at the time you place your order.
We recommend saving or printing a copy for your records.
31. If there is a problem
If you have a problem with your order, please contact us first so we can try to put things right.
Email:
support@nicelypersonalised.com
Please include your order number, name and a short explanation of the issue.
We aim to deal with problems fairly, promptly and in a way that reflects the care we put into our products.
32. Governing law and jurisdiction
These terms are governed by the law of England and Wales.
If you are a consumer living in another part of the United Kingdom, you may also have rights under the laws of that part of the UK.
Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
